Southeast Banking Corporation Global Settlement

This website has been established to provide interested parties with information and materials related to a Global Settlement by, between and among Jeffrey H. Beck, as Chapter 7 Trustee, Gabriel Capital L.P., and the Ad Hoc Committee of Subordinated Noteholders.

This website provides access to materials intended to educate interested parties with respect to the terms of the Global Settlement and procedures for its approval by the Bankruptcy Court.

Please note that the Summary of Global Settlement does not purport to summarize each relevant element of the proposed Global Settlement, and is qualified in its entirety by the provisions of the Settlement Order, which governs in the event of any inconsistency.

The hearings to consider the Global Settlement Motion and the Eighth Interim Distribution Motion were held on Monday, November 3, 2003 at 1:00 p.m. Following presentations by counsel for the Trustee and other parties in interest, the Honorable Paul G. Hyman, Jr. issued the Order Approving and Implementing Global Settlement and the Order Authorizing Eighth Interim Distribution, both without objection by any party in interest. Following the hearing and consultation with the Indenture Trustees for the Debtor's Senior and Subordinated Notes, the date of November 17, 2003 has been declared as the Record Date for the U.S. Notes.

Both of the Orders were entered on the Court's docket on November 5, 2003 and may be accessed on this website by clicking on the link titled Court Pleadings. Pursuant to Federal Rule of Bankruptcy Procedure 8002, parties in interest shall have up to and including Monday, November 17, 2003 to file a notice of appeal of the Orders. Absent stay of the Order Authorizing Eighth Interim Distribution, the Trustee expects the distribution of $30 million to proceed before the end of November 2003.
